1. Agreement to Terms
By downloading or using the Meemiq mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you and the operator of Meemiq. Please read them carefully before using the App.
2. About Meemiq
Meemiq is a German language learning application that teaches through interactive story-driven scenarios and AI-assisted speech practice. The App is designed for users aged 16 and above.

3. Eligibility and Account Registration
To use Meemiq, you must be at least 16 years old. By creating an account, you confirm that you meet this requirement.
When registering, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your login credentials secure and confidential
Notify us immediately of any unauthorized use of your account at meemiqapp@gmail.com
You are solely responsible for all activity that occurs under your account.
4. Subscriptions and Payments
4.1 Billing
Subscriptions to Meemiq's premium features are processed exclusively through Apple's App Store. By subscribing, you agree to Apple's payment terms in addition to these Terms.
4.2 Pricing
Subscription prices are displayed in your local currency at the time of purchase. Prices may vary by region and are subject to change with advance notice.
4.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
4.4 Managing Subscriptions
You can manage or cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period — you will retain access until then.
4.5 Refunds
All refund requests are handled directly by Apple in accordance with their refund policy. You can submit a refund request at reportaproblem.apple.com. Meemiq does not process refunds directly.
5. Right of Withdrawal (EU Users)
As a consumer in the European Union, you have the right to withdraw from a digital content purchase within 14 days of the date of purchase, without giving a reason ("cooling-off period").
To exercise your right of withdrawal, contact us within 14 days of purchase at:

Please note: Since Meemiq subscriptions are processed through Apple, you may also exercise your withdrawal right directly through Apple's refund process at reportaproblem.apple.com.
Once the withdrawal period has expired and the service has been actively used, the right of withdrawal may no longer apply, consistent with applicable EU consumer law.
6. Acceptable Use
You agree to use Meemiq only for lawful purposes and in accordance with these Terms. You must not:
Share your account credentials with any other person
Attempt to reverse engineer, decompile, or disassemble the App
Use the App to transmit any unlawful, harmful, or offensive content
Attempt to gain unauthorized access to any part of the App or its systems
Use automated scripts, bots, or tools to access or interact with the App
Reproduce, distribute, or create derivative works from any App content without written permission
Violate any applicable laws or regulations
We reserve the right to investigate violations and take appropriate action, including account suspension or termination.
7. Intellectual Property
All content within the App — including but not limited to stories, videos, audio, text, graphics, logos, and software — is the exclusive property of Meemiq and is protected by German and international copyright and intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the App for personal, non-commercial purposes only.
Nothing in these Terms transfers any ownership rights to you. You may not copy, reproduce, distribute, or exploit any App content without our express written consent.
8. Privacy and Data Protection
Meemiq collects and processes personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains what data we collect, why, and what rights you have under the EU General Data Protection Regulation (GDPR).
By using the App, you acknowledge that you have read and understood our Privacy Policy. You can access it at: meemiq.app/privacy
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding specific learning outcomes.
10. Limitation of Liability
To the maximum extent permitted by applicable German and EU consumer law, Meemiq shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.
Nothing in these Terms limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded under applicable law.
For EU consumers: these limitations do not affect your mandatory consumer rights under the law of your country of residence.
11. Account Termination
11.1 Termination by You
You may delete your account at any time through the App's settings or by contacting us at meemiqapp@gmail.com. Upon deletion, your data will be processed as described in our Privacy Policy.
11.2 Termination by Meemiq
We may suspend or terminate your account if you materially breach these Terms. In cases of serious violations (e.g., fraud, illegal activity, or abuse of the platform), we may act immediately without prior notice.
In all other cases, we will provide at least 30 days' written notice via email before terminating your account without cause. If we terminate your account without cause, you will be entitled to a pro-rata refund for any unused portion of a paid subscription, processed through Apple.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in the law, our services, or for other legitimate reasons.
For any material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. You will have the option to cancel your subscription before the new Terms apply.
If you continue to use the App after the notice period, this constitutes your acceptance of the updated Terms. If you do not agree, you may terminate your account before the changes take effect.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.
For EU consumers: Nothing in this clause affects your right to rely on the mandatory consumer protection laws of your country of residence within the European Union.
14. Dispute Resolution
We aim to resolve any disputes amicably. If you have a complaint, please contact us first at meemiqapp@gmail.com and we will do our best to resolve it within 14 days.
For EU users: If we cannot resolve a dispute directly, you may use the European Commission's Online Dispute Resolution (ODR) platform:

You also retain the right to bring proceedings before a court of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable law, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

We may update these Terms from time to time to reflect changes in the law, our services, or for other legitimate reasons.
For any material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. You will have the option to cancel your subscription before the new Terms apply.
If you continue to use the App after the notice period, this constitutes your acceptance of the updated Terms. If you do not agree, you may terminate your account before the changes take effect.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.
